Have your patients been able to fill their CS prescriptions?
Posted over 8 years ago by Doreen Cassarino
There have been reports that when patients present a valid prescription for a controlled substance to their pharmacy that they are being told that it cannot be filled, that NPs in Florida cannot prescribe controlled substances.
Please comment to this post your experience in this regard and include the county or counties that your practice serves so that FNPN can best focus efforts towards educating our colleagues and ultimately improving access to care. Comments regarding whether or not your patients have or have not had pushback are valuable.

Have not written for cs in FL, but have as locum tenens in small towns of NH and VT. Until they got to know me, all area pharmacists would call me to verify....
I began using my DEA for prescribing psychiatric CS last week in Miami Dade and have not had any issues yet. When calling CS to pharmacies a few pharmacists were not aware that now ARNPs can prescribe CS in Florida. After explaining the new law they were able to run prescription successfully.
Independent pharmacies in my area are aware NPs and PAs law passed effective Jan 1st and no problems there but hearing it's the larger chain pharmacies who refuse. Let's get this fixed right away - to make sure patients are not negatively impacted!
It seems so - we've had some delays and calls from pharmacies who had no idea of the law change. Leon Co. (PS would really like some guidance on handling Tramadol and Benzo Rx's - how long/ how many? I have a few trusted patients who use these pretty much daily in a responsible manner... )
I have not had any problems so far in my area.
Thanks for sharing. We're trying to get an idea of how widespread the problem is. We knew there would be some "growing pains" and hope that we can help with the transition.
I had this problem in Bay county and it was a large chain pharmacy.
I just got a notice five by the DEA that I have to have a master's degree registered with the Florida Department of Health. I got my license in 2007 and I just renewed it recently and all those documents have to be on file otherwise I wouldn't have the license I do have a master degree and a postmaster certificate. This is a new wrinkle here because a lot of people have post Masters certificates which means they have a master's degree. I've contacted them and explain that you can't get a license now without a master's degree. I don't know where they got the information that the Department of Nursing not have my information stay tuned as I hear back from them. This seems like a stalling tactic to me
I know it's off topic they probably just don't know what they're doing lol I didn't mean to hijack the thread. I'm not taking it personally it's just frustrating after all these years to have these little wrinkles
Express Scripts is refusing to accept our scripts via mail order. I had to send the patient locally to the pharmacy to get it filled.
I am a psychiatric nurse practitioner. I work in a child, adolescent and psychiatry practice. 3 separate pharmacists, all from C VS pharmacies refused to fill my prescriptions for psychstimulants. All pharmacies are located in naples, florida. They are confused about interpretation r/e quantity limits for psychiatric controlled medications. As psychiatric ARNPS we are exempt from 7 day limit for psychiatric controlled medications. HB 977 law. I have a DEA and revised practice agreement on file with the state. Previously prescribed controls in new york for ten years. Congratulations Florida!
I'm still trying to get the board of nursing to finalize the controlled part. I'm a bit confused because the legislation looks like the only real restriction is schedule II for one week and psychotropics for those under 18 but the board of nursing is saying we can't write any benzos or other controlled that are considered "psych" for any age. Can anyone clarify?
